This Blog is set up to assist attorneys responding to various "Debt Elimination", "monetary protester", "money lent", "Modern Money Mechanics", "Mandrake Mechinism", "'The Creature from Jekyll island" and "militia" types of defenses to credit card accounts. Typically these defenses are based upon the Plaintiff not being a holder in due course, failure to prove that the Plaintiff uses "generally accepted accounting principles", the "FDCPA", and Fair Credit Billing Act. As I have time I will post

Hi,

I am involved in a debt elimination and it is not turning out quite the way that I had envisioned or how it was sold to me. I am wondering if you might be able to help me or point me in the right direction.

I contracted with Capital Resource Group to handle my debt elimination back on September 23, 2003. People I worked with were Greg Barrett and Mike Rozell.

Binding Arbitration was filed for all my accounts with Solomon Arbitration Group on January 20,
2004 and Arbitration Awards were granted on March 1, 2004.

On April 26, 2004 I agreed to have my Arbitration Awards confirmed through the courts. Capital
Resource Group evidently contracted with a third party law firm to handle this. To date I have
not received confirmation from the courts and the last I heard there was another delay and would
take another 30 days, which would have ended last week. Now I understand that there is another
delay.

In the meantime, Discover Bank has filed a lawsuit against me in the County Court of Sarasota, Florida
and I have until Tuesday Sept 7th to respond to that. I asked someone at Capital Resource what I
should do and they ssent me a one line email which said "Make a minimal payment offer until your awards are confirmed". Somehow that just doesn't sound right to me.

Also, MBNA Bank has won it's own Arbitration Award through the National Arbitration Forum and a law firm is attempting to collect.

At this point Capital Resource Group is not giving me any help or feedback whatsoever, I don't
understand why. And I paid them $4900 to handle this! I have called and emailed until I am blue
in the face to no avail.

I'm totally confused and freaking out. I was laid off from my job, savings is gone, and I'm just
trying to figure out how to get out of this and start my life over again. Is there any chance that you could give me some advice on what my best course of action is?

Thanks for any help or suggestions you might have!
